The information and software on Oceano Fresco’s website is protected by copyright. Customer is granted a license to view, on a temporary and individual basis, the Oceano Fresco’s website. EXCLUSION OF LIABILITY

From time to time, Oceano Fresco’s website may contain technical inaccuracies or typographical errors and Oceano Fresco’s holding company does not warrant the accuracy of any information posted on this website.

If any term of these Terms of Use is found in any way invalid by a competent judicial authority, the validity of the remaining Terms of Use shall remain unaffected, provided that such defect does not materially affect the rights of the parties under these Terms of Use.

CONFIDENTIAL INFORMATION

The company that owns the Oceano Fresco website does not intend to receive any confidential or proprietary information from the Customer through this website. The Customer should note that any information or materials sent to Oceano Fresco will be considered non-confidential.

WAIVER OF WARRANTY

Use of this website is at the Customer’s own risk. All information and software are provided “as is” without any warranties. To the fullest extent permitted by law, Oceano Fresco’s holding company expressly waives all warranties or representations, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose and non-infringement of intellectual property rights. In particular, Oceano Fresco’s holding company does not warrant the uninterrupted, timely, secure and error-free operation of this website.

The Customer acknowledges and agrees that if it downloads or otherwise obtains materials, information or software from this website, it does so at its sole discretion and responsibility and is solely responsible for any damages that may arise, including loss of data or damage to the computer system.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, in no event shall Oceano Fresco’s holding company be liable to any third party for any direct or indirect damages, including lost profits, related to or arising out of this website or its use, or any website, referenced or accessed through this website (if applicable). This limitation of liability applies to all causes of action, whether they be contract, warranty, unlawful acts or any other grounds.

Purchase and Shipping Policy

  • Sales prices include transport for minimum order quantities located in mainland Portugal.
  • The aforementioned sales prices are valid for the year 2023 unless updated.
  • Price updates. Oceano Fresco, SA reserves the right to change its sales prices with a notice of up to 30 days, regardless of any subsequent commercial agreement.
  • Payment conditions. Payments must be made in cash and deliveries will be confirmed to customers upon receipt of payment.
  • Returns. Oceano Fresco, SA will not accept returns.
  • Does not deliver. Oceano Fresco, SA will not accept penalties for late deliveries.
  • No guarantee the availability of quantities to order, since it is a 'limited edition' of canned food.

APPLICABLE LAW

These Terms of Use shall be governed by and construed in accordance with Portuguese Law. All disputes shall be subject to the exclusive jurisdiction of the Judicial Court of the District of Lisbon.
